The term "Probate" refers to the manner of administering the property (the estate) of a deceased or incapacitated individual by a personal representative.

 

When someone dies leaving an estate with assets requiring formal estate administration, an executor or administrator must qualify with the Court in the City or County where the decedent resided at time of death, and, if there is a will, probate the will.

 

The timeframe for closing an estate is dependent upon the complexity of the estate. Most estates will take at least one year to close.
